2. Shopify and Third-Party Integrations
First Profit connects with Shopify, Meta Ads, TikTok Ads, Google Ads, and other third-party platforms.
By integrating your accounts, you:
Authorize us to access necessary data (such as ad spend, orders, and revenue) to provide profit tracking and insights
Confirm you have the right to share this data with us
Agree to comply with the terms of service of those third-party platforms
We are not responsible for the functionality, policies, availability, or downtime of these third-party services.
3. Fees and Payments
Some features of First Profit require a paid subscription.
Prices and plans are displayed on our website and the Shopify App Store listing
All fees are billed automatically through Shopify's billing system
Subscriptions renew automatically unless cancelled
You can cancel your subscription anytime through your Shopify admin
No refunds are provided for partial billing periods, except as described below
12-Month Money-Back Guarantee
We offer a 12-month money-back guarantee under the following conditions:
You must have actively used the Service for at least 12 consecutive months
You must contact support@firstprofit.app to request a refund
We may request brief feedback to help us improve
Refunds will be processed within 30 days of approval
This guarantee demonstrates our confidence in the value First Profit provides.
4. Data and Privacy
We respect your privacy. All data is encrypted and securely stored. We never sell your information.

You are responsible for ensuring you have the right to share any data you provide to us, including customer or business data from your connected accounts.
5. Intellectual Property
All content, software, branding, and materials available through First Profit are our intellectual property (or our licensors') and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, reverse engineer, or sell any part of the Service without our prior written permission.
You retain ownership of your data. By using the Service, you grant us a limited license to process your data solely to provide the Service.
6. Disclaimer of Warranties
First Profit is provided "as is" and "as available" without warranties of any kind, either express or implied.
While we strive for accuracy, we do not guarantee that:
All profit, cost, or analytics data will be error-free
The Service will be uninterrupted or available at all times
The Service will meet all of your specific requirements
We are not financial advisors. The analytics and insights provided are for informational purposes only and should not be considered financial, tax, or legal advice.
7. Limitation of Liability
To the maximum extent permitted by applicable law, First Profit and its owners, employees, and affiliates shall not be liable for:
Any indirect, incidental, special, or consequential damages
Loss of profits, revenue, data, or goodwill
Business interruption or losses arising from your use of the Service
Any amount exceeding the fees you paid to us in the 12 months preceding the claim
Your sole remedy for dissatisfaction with the Service is to stop using it.
8. Indemnification
You agree to indemnify and hold harmless First Profit and ORUM OCCHIALI SRL, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Any data you provide through the Service
9. Termination
By you: You may stop using the Service and uninstall the app at any time through your Shopify admin.
By us: We may terminate or suspend your access immediately, without prior notice, if we detect:
Misuse or abuse of the Service
Fraudulent activity
Violation of these Terms
Upon termination, your right to use the Service ceases immediately. Data deletion follows our Privacy Policy.
10. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of Italy, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Florence, Italy, and you consent to the exclusive jurisdiction of such courts.
For EU consumers: Nothing in these Terms affects your statutory rights under applicable consumer protection laws.

We may update these Terms occasionally. When we do, we will:

Notify you of material changes via email or in-app notification

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and First Profit.
Severability: If any provision of these Terms is found invalid, the remaining provisions remain in effect.
No Waiver: Our failure to enforce any right or provision does not constitute a waiver.
Assignment: You may not assign these Terms. We may assign our rights to any affiliate or successor.
